Learned counsel appearing for the petitioner submits that petitioner was in a love relationship with the victim and he has been falsely implicated after sixty two days of the alleged incident. 2.

Learned counsel appearing for the State has produced the case diary and has submitted that there are incriminating materials suggesting the involvement the petitioner along with one Jhantu Samaddar in the commission of alleged crime.

The call details report (CDR) of the petitioner and the victim also placed before us for our consideration.

Considering the material available in the case diary, the call details report (CDR) available in the case diary which prima facie shows that petitioner and the victim were in conversation prior to the date of the alleged incident and the death was due to the effects of injuries as reveals from the post mortem report and the investigation is at the initial stage, we are not inclined to grant the anticipatory bail to the petitioner.
