Heard the parties.

The grievance of the petitioner is directed against the failure on the part of the respondent authorities to consider his representation dated 10th April, 2012. It is alleged on behalf of the petitioner that the petitioner had made an application for transfer of a lease granted in favour of the predecessor-in-interest of the petitioner.

The petitioner submits that he is ready and willing to comply with all the formalities including the payment of the transfer fees as per the Government Circular dated October 12, 2010.

The petitioner further submits that he also is ready and willing to comply with all necessary regulations and provisions of law to effect such transfer.

The State is represented and submits that the petitioner must comply with all the relevant provisions of law including the payment of fees in order to effect such transfer.

I have heard the parties.

Considering the submissions made on behalf of both the parties, I am of the view that the respondent No.2 should consider and dispose of the representation dated 10th April, 2012 by giving a right of hearing to the petitioner and the State respondents and passing a reasoned order within eight weeks from date.

In view of the submission made on behalf of the petitioner, the Respondent No.2 will also consider the question of payment of the necessary fees and charges in the light of the extant rules and Government notifications which the petitioner is liable to pay before effecting such transfer.

Nothing in this order will influence the respondent No.2 on the merits of the representation.

With the aforesaid directions, WPA 13922 of 2012 stands disposed of.

However, there will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
