Avijit Sen v. State Of West Bengal And ANR
12.09.2025.
22.
Ct.No.7.
as C.R.R. 3291 of 2025 In the matter of : Avijit Sen.
.... Petitioner.
Mr. Rajarsi Basu.
...for the Petitioner.
1.
The present application has been filed seeking a direction upon the learned Court below to dispose of Complaint Case No. AC 699 of 2020 expeditiously.
2.
Record reveals that in an earlier revisional application preferred by the petitioner, registered as CRR 1730 of 2023, a Coordinate Bench of this Court directed the learned Court below to fix at least one day every two months for the trial of the present case, so that it may be concluded within a reasonable period without granting unnecessary adjournments to either party. The Hon'ble Bench further clarified that if any dilatory tactics are adopted by the parties, the learned Court below would be at liberty to impose exemplary costs, if the learned Magistrate finds that adjournments are sought on flimsy grounds.
3.
Having heard the learned Advocate appearing for the petitioner and upon perusal of the materials on record, I am of the view that since a Coordinate Bench has already given such direction to the learned Court below to conclude the trial expeditiously, no further direction for expeditious disposal of the case is necessary. If the petitioner finds that this order is not being complied with by the learned Trial Court in its letter and spirit, the petitioner shall be at
liberty to bring the matter to the notice of that Hon'ble Bench by filing an appropriate application.
4.
With this observation and order, the revisional application is disposed of.
