The petitioners contend that although respondent no. 4 claims to be a cosharer of the relevant property in a probate proceeding, the probate court has rejected the petitioners' claim. The right, title, and interest of the petitioners have been duly established.

It appears that the electricity connection was initially provided to the petitioners pursuant to an order dated February 6, 2018, passed in W.P. 7267(W)/2016. A report submitted by CESC, at page 145 of the writ petition, indicates that the electricity connection in favour of respondent no. 4 was effected from a common meter board situated in a shared passage.

Unless respondent no. 4 is lawfully evicted from the

premises through due process of law, he is entitled to continue enjoying the electricity connection. Accordingly, WPA 17173 of 2025 is dismissed.
