The petitioner alleges that a drain had been excavated by the Hantal Anantabati Gram Panchayat and due to the clogging of the drain and poor maintenance, the dirty water from the drain is entering into the land of the petitioner, situated at Dag No.569 of Mouza-Anantabati. The petitioner approached the panchayat authorities as also the Block Development Officer.

Undoubtedly, the civic body and/or the local body is duty bound to ensure a clean and habitable environment in the locality. It is also their duty to develop the area and also maintain the sewerage.

Under such circumstances, the writ petition is disposed of with a direction upon the Block Development Officer, Jagatballavpur Development Block to ensure that the Hantal Anantabati Gram Panchayat cleans up the drain

and prevent water logging and stagnation of the dirty water not only around the premises of the petitioner, but in the entire locality.

The Block Development Officer shall take action within a period of four weeks from receipt of the copy of the writ petition.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
