The present petitioner had applied for a new vacancy of FPS Dealership under the West Bengal Public Distribution System (Maintenance & Control) Order, 2013 at the location of Kalikapur Barasat (CT), G.P. Office under Gram Panchayat Dakshin Barasat, Police Station Jaynagar, South 24Parganas.

Initially, the present petitioner applied for the said FPS Dealership by virtue of a Notification dated 26.03.2022 after filing of the said application in terms of the Notification, the State Authority has not acted properly. Thus, he preferred a writ petition before this Court in WPA 15832 of 2024.

This Court when in seisin over this matter a submission was made on behalf of the State Authority that the Notification dated 26.03.2022 has been canceled and in it's placed further Notification dated 25th June, 2024 has been published. Now the present petitioner appears before this Court on the

ground that till today no action has been taken by the State Authority to publish the Notification dated 25.06.2024. He submits that the State Authority has adopted a dilatory tactics to debar the present petitioner to participate in the proceeding.

Learned counsel appearing on behalf of the State Authority submits that the State had adopted necessary procedure so that the Notification dated 25th January, 2024 be published in the Newspaper. Having heard the parties and considering the rival submissions it appears to me that the State must acted promptly in this matter. The Authority concerned to advertize Notification dated 25th January, 2024 in the Newspaper as early as possible most preferably within eight weeks from this date. Under the above observation, the instant writ petitioner is disposed of.
