The petitioner claims to be a tenant of the said premises under respondent no. 4.
Learned counsel appearing for respondent no.
4, however, submits that it was the petitioner's mother who was the tenant, and that the petitioner does not reside at the premises.
It is, however, undisputed that an eviction suit is pending at the instance of respondent no. 4 to evict the petitioner from the said premises.
Learned counsel appearing for the Calcutta Electric Supply Corporation (CESC) submits that an inspection was scheduled by CESC following the petitioner's application for a new connection.
However, the inspection could not be carried out due to objections raised by respondent no. 4.
In view of the above, there is no justification to keep this writ petition pending.
CESC is hereby granted liberty to conduct an inspection of the premises. Based on the outcome of the inspection, CESC shall decide whether to provide the connection to the petitioner, in accordance with law, subject to compliance with all necessary formalities.
The entire exercise shall be completed within a period of six weeks from the date of this order. CESC is also granted liberty to seek police assistance from the local police station to enforce this order. If necessary, the police may break open the padlock of the meter room. The cost of such police assistance shall be borne by the petitioner.
Accordingly, WPA 17113 of 2025 is disposed of.
Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
