Bihani, Advocates ... for the State The allegation in this public interest petition is that e-tenders were issued for strip plantation within Digshili Mouza under Purulia Range for an area of 22 hectares within Kanchanpur and Udaypur Mouza as also in Tara Mouza under Raghunathpur Range but no plantation as per the tender has been done.

The record reflects that the petitioner has already filed representation dated 03.02.2022 in this regard before respondent No.4, the District Magistrate, Purulia. The said representation has not been considered till now. The issue which the petitioner is raising require factual inquiry and ascertainment of the position on the spot in respect of the performance of work in pursuance to the contract, for which the District Magistrate is the appropriate authority, to whom the representation is already submtited.

Hence, we dispose of the present petition with a direction to respondent No.4 to duly consider the

WPA(P) 362 of 2022 representation dated 03.02.2022 in accordance with law as expeditiously as possible, preferably within a period of 3 months from the date of receipt of the copy of this order.

It will be open to the petitioner to submit all the relevant additional material along with certified copy of this order before respondent No.4.

Accordingly, the present petition is disposed of. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of requisite formalities.
