The writ petitioner claims that he was lawfully working in the Group-"D" post in Belgachia Monohar Academy (Higher Secondary), Kolkata. He claims to have been appointed in the year 2006. Subsequently, two vacancies arose in the School in respect of two other Group-"D" posts. The petitioner claims that he is entitled to be either absolved permanently towards a regular vacancy or should be allowed to participate in the recruitment process upon by the sanction by the State.
Admittedly the petitioner's appointment is casual.
Counsel for the School submits that the
petitioner was appointed at the instance of the Secretary of the School and has not been approved by the Managing Committee of the said School.
In those circumstances, no relief can be granted to the writ petitioner in this writ petition. All appointments given to Group-"D" posts are required to be made post 1997 through School Service Commission.
With the aforesaid directions, the instant writ petition shall stand disposed of without any further order.
There will be no order as to costs.
