The writ petitioner claims that the private respondent encroached upon public land, which is blocking free ingress and egress into his property. The private respondent, who is represented, vehemently opposed and denied the same.

The petitioner has made a representation dated 12th July, 2019 to the Executive Engineer, Diamond Harbour Highway, PWD (Roads) in this regard but in vain.

In that view of the matter, the respondent no.5, namely, Executive Engineer, Diamond Harbour Highway, PWD (Roads) shall dispose of the petitioner's representation, after hearing the writ petitioner as well as the private respondent and any other interested parties, in accordance with law, within a period of two months from the date of communication of a copy of this order.

In so far as the alleged inaction of Kulpi Police Station is concerned, this Court notes that the proceedings under Section 107 of the Code of Criminal Procedure have already been drawn up.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
