Mr. Mukunda Lal Sarkar Mr. Sounak Bhattacharya ...for the petitioners The petitioners in this application under section 24 of the Code of Civil Procedure, 1908 are seeking transfer of Misc. Appeal No.28 of 2022 from the court of learned Additional District Judge, FTC-IV, Barrackpore, North 24 Parganas on the grounds of delay to any of the competent courts at Barrackpore itself for speedy disposal of the case. Learned counsel for the petitioners submits that the misc. appeal has not been disposed of by the concerned court which is required to be expeditiously disposed of. Hence learned counsel prays for transfer of the same to any other competent court for early disposal of the case. After hearing learned counsel and on consideration of the case stated in the s.24 CPC application and considering the fact that the appeal is posted for hearing in the concerned court on September 7, 2022, I feel that it would be wise to dispose of the revisional application directing as follows.

The learned Additional District Judge, FTC-IV, Barrackopore is directed to hear and dispose of Misc. Appeal No.28 of 2022 as expeditiously as possible, preferably on the next date of hearing i.e. on September 7, 2022.

With the directions as above, CO No.2308 of 2022 stands disposed of. No order as to costs.

Let this order be communicated to the learned court below immediately.
