And In Re : Rajesh Shaik Sk. Humayan Reza ... For the Petitioner.
Mr. Bitasok Banerjee Mr. Abhishek Verma ... For the State The petitioner is in custody for more than 2 years and prays for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record.
The petitioner has been accused of murder. The gait pattern of the petitioner has matched with that of the CC TV footage and place of occurrence. Torn portion of the pocket of a shirt found at the place of occurrence has matched with the shirt recovered from the house of the petitioner at his instance.
This Court is informed that the prosecution proposes to examine 30 witnesses out of whom 27 witnesses have already been examined.
Considering the material on record and prima facie involvement of the petitioner in the alleged crime, prayer for bail is rejected at this stage.
Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
