Perused the case diary.
The prosecution case is that within six months of marriage when the victim wife was two months in the family way, she was brutally assaulted by the husband and the other in-laws. While in the injury report the victim had taken the names of the husband, the mother-inlaw, the sister-in-law and the sister-jaa, in her statement she had taken the names of the "jaa", "nanad" and the "husband". Considering the above and the other incriminating material available in the case diary while I am inclined to grant anticipatory bail to the petitioner nos. 1, 2 and 6, the application for anticipatory bail of the petitioner nos. 3, 4 and 5 is rejected.
Thus, in the event of arrest, the petitioner Nos. 1, 2 and 6 shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioner Nos. 1, 2 and 6 shall cooperate with investigation and shall not threaten or intimidate witnesses.
Accordingly, the application for anticipatory bail is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
