The petitioner claims that he is working as a Chowkidar at Jalkhura Super Market in South 24-Parganas Zilla Parishad. Admittedly, the petitioner was not engaged in terms of any prescribed procedure.

It is submitted that after having served for 10 years, the petitioner has been asked to go home suddenly by the new incumbent namely, the Assistant Engineer.

This Court notes that the petitioner cannot have any right, whatsoever, against the State to claim any permanency or any engagement with the Zilla Parishad in question. The petitioner's representation dated 24th September, 2018 may, however, be considered by the South 24-Parganas Zilla Parishad

namely, the respondent no.5 herein in the event, any Chowkidar is proposed to be engaged.

It is made absolutely clear that the consideration shall be strictly in accordance with the applicable Rules.

Md. Sarwar Jahan, learned counsel for the petitioner, very fairly admits that his client cannot otherwise have any right, whatsoever, against the Zilla Parishad or the State.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
