Learned counsel appearing for the petitioner submits that the petitioner bank has made an application with request to render assistance to the secured creditor being the petitioner herein while taking the possession under the SARFAESI Act. Learned counsel appearing for the State submits that if the petitioner bank deposits an amount to be specified for the force to be supplied to the petitioner for their assistance and a fixed date is mentioned then adequate police force will be deployed with the Manager of Bank of Baroda.

Learned counsel appearing for the private respondent submits that the order passed by the District Magistrate is not reasonable.

Heard learned counsel appearing for the parties.

The authorized officer of the Bank of Baroda is requested to deposit the cost to be fixed by the police authorities and deposit the same and thereafter send a copy of the challan to the Officer-in-charge of the concerned police station mentioning specific date and time. On receipt of the same, the Officer-in-charge of the concerned police station shall make necessary arrangement and render necessary assistance to the authorized officer of the Bank of Baroda, the petitioner herein.

Accordingly, the writ petition being WPA 18135 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
