There is a dispute with regard to the petitioners' title to the property. The private respondents claim that the petitioners' father was not a lawful bargadar. The private respondent no. 5 is an ex secretary of the School adjacent to the petitioners' property. The original owners of the property intend to donate the land of the petitioners to the School.

Counsel for the petitioners vehemently denies the same. It is submitted that the private respondents are illegally trying to grab their property. Counsel for the private respondents denies the same.

The dispute between the parties may be decided in an appropriate civil or statutory forum.

Counsel for the State submits that Basanti Police Station has taken out proceedings under

Section 107 of the Cr. P. C. against the private respondents.

The O. C., Basanti Police Station shall ensure that there is no breach of peace in the area With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
