Report as called for by the Order dated April 18, 2024 passed by the Co-ordinate Bench be taken on record.

Application is for cancellation of a bail granted by the jurisdictional court. Application is at the behest of the State.

As against some of the co-accused, High Court was pleased to cancel the bail granted in favour of such co-accused. Ultimately, there subsist an order passed by the Hon'ble Supreme Court in a Special Leave Petition staying the order of cancellation of bail in respect of such co-accused.

We note that the police case is dated August 3, 2019.

In such police case, charges are yet to be framed by the learned jurisdictional court.

Purely on the principles of Article 21 of the Constitution of India on the ground that, right to speedy trial of the accused stands infracted, in the facts and circumstances of the present case, we are not minded to interfere with the order granting bail to the private respondent.

C.R.M. No. 7557 of 2021 is, therefore, disposed of.
