Supplementary affidavit filed by the petitioner is taken on record.

The petitioner has assailed the order passed by the learned Additional Sessions Judge, Haldia, Purba Medinipur on 30th April, 2024 in Criminal Revision No.40 of 2024 rejecting the application for stay filed by the petitioner.

By an order passed on 4th April, 2024 in Misc. Case No.137 of 2020, the learned Judicial Magistrate, Haldia granted interim maintenance to the opposite party to the tune of Rs.5,000/- per month.

It appears that a Misc Execution case being No.106 of 2024 has been filed by the opposite party for execution of the said order.

Learned counsel for the petitioner submits that the petitioner shall appear before the learned executing court on the next date fixed by the learned Court and shall

deposit the entire due amount of Rs.30,000/- before the Court.

Since the petitioner is ready and willing to deposit the arrear amount due as well as to continue to pay the interim maintenance at the rate of Rs.5,000/- per month to the opposite party, the warrant of arrest issued against the petitioner in Misc. Execution Case No.106 of 2024 be stayed till 20th December, 2024 subject to the petitioner abiding by the undertaking given by him.

In the event the petitioner fails to deposit the arrear amount before the learned executing court on the next date the learned executing court shall take necessary steps in accordance with law without further reference to this Court.

Since nothing further remains to be adjudicated in the present application, the application being CRR 2944 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
