From the report, it reflects that already a case has been registered being Beldanga P.S. Case No. 439 of 2024 dated 16.06.2024.

Pursuant to complaint being forwarded,

authorities have also drawn a proceeding under Section 163(2) of the BNSS.

It has been complained of on behalf of the petitioner that in spite the order being passed by the learned Civil Court for not changing nature, character and possession of the suit property, the private respondents have violated such order and taken steps by way of alienating the said property and by cutting down the trees.

Learned advocate for the private respondent(s) disputes such contentions.

The authorities are completely in knowhow of the disputes between the parties, the civil suit is pending as well as the criminal case has been registered and steps have been taken by the police authorities for ensuring that no breach of peace takes place at the locale.

However, the petitioner and the private respondents are at loggerhead and, each of them would approach before the learned jurisdictional court which is in seisin of the matter for seeking remedies in respect of the right, title, interest, possession of the said property and/or violation of any order passed by the learned Civil Court.

However, authorities would keep a strict vigil, in the meantime, so that there is no tension and/or other serious pandemonium created at behest of the parties, who are fighting over the land in dispute.

With the aforesaid observations, WPA 19381 of 2024 is disposed of.
