1. This application under section 482 of the BNSS has been filed by the petitioners apprehending arrest. During the pendency of the matter the 50% that is Rs.7,76,860.00/-, of entire final assessed amount to the tune of Rs.1,553,720.00/-, has been paid in favour of CESC by the petitioners. To that extent, a copy of the CESC bill has been filed before this Court and the same be kept with the record.

2. The learned advocate appearing on behalf of the CESC also concurs with the said fact.

3. In view of the present facts and circumstances and considering the nature of allegation levelled, this Court is inclined to extend the benefit of section 482(2) of the BNSS to the petitioners.

4. Prayer for anticipatory bail stands allowed.

5. Accordingly, in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs. 5,000/- with two sureties of like amount to the satisfaction of the arresting officer subject to the condition laid down in section 482(2) of the BNSS.

6. The application for anticipatory bail is, thus, disposed of.

7. Case Diary is, however, returned.

8. Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities.
