Mookherjee, AG Mr. Anirban Ray, GP Mr. Raja Saha Mr. Nilotpal Chatterjee ... ... for the State The petitioner by way of this petition has sought a direction to the respondents to grant permission for Bhairab Puja from 17th November, 2021 onwards and Nagar Parikrama on 21st November, 2021.

As per the averments made in the petition, the Bhairab Puja was to take time for five days from 17th November, 2021 to 21st November, 2021. The said period is already over.

Vide Annexure P-4 dated 16th November, 2021 the petitioner has submitted application seeking permission for Nagar Parikrama of Baba Bhairab on 21st November, 2021. The said date has already passed.

Learned counsel for the petitioner has stated that there was no order passed on application dated 16th November, 2021 and that the Nagar Parikrama of Baba Bhairab has now been postponed for 23rd November, 2021.

Counsel for the State has stated that if the petitioner files any fresh application seeking permission then the same will be duly considered. Counsel for the State has assured if such an application is filed today the same will be decided today itself.

In view of this matter, we dispose of the writ petition granting liberty to the petitioner to file afresh application seeking such permission before the respondent no. 6. If such application is filed physically or virtually by way of e-mail today, the same will be considered and appropriate decision in accordance with law keeping in view the local circumstances and Covid protocol and decision will be taken by the said respondent without any delay on filing such an application.
