14.02.2025 Sl No.2 Court No.37 (gc) RVW 246 of 2023 CAN 1 of 2023 In MAT 1347 of 2023 Mrs. Kabita Baidya Vs.

State of West Bengal & Ors.

1.

The review applicant is not represented, nor accommodation is prayed for on behalf of the review applicant.

2.

The applicant is a teacher-in-charge of Barisha Asar Vidyapith for Girls. On 14th September, 2023, we dismissed the appeal on the ground that the audited account was placed before the District Inspector of Schools (S.E.), Kolkata and it appears that the President of the Managing Committee on 14th June, 2022 issued a 'No Liability Certificate' in favour of the writ petitioner. The said certificate could not have been issued unless a satisfaction is recorded by the Managing Committee with regard to the fair conduct of the writ petitioner. The writ petitioner was Headmistress, who served the institution from 1st February, 1996 to 31st July, 2022. We, accordingly, dismissed the appeal. The appellant was represented and heard.

3.

The appellant now seeks to review the said order on the basis of a report dated 12th July, 2023 alleging discrepancy in the accounts.

The writ petitioner retired from service in July, 2022 and the said report could not be relied upon at this stage to have the review of the entitlement of the writ petitioner. The appellant had the opportunity to produce the said report on the date when the appeal was heard, in fact, the appeal was disposed of on 14th September, 2023 and the documents now sought to be relied upon are all between February, 2023 and August, 2023. Moreover, the District Inspector of Schools (S.E.), Kolkata did not make any adverse comment on the audited account that was placed before the said authority.

4.

On such consideration, we do not find any reason to review our order.

5.

Accordingly, the review application and the connected application are dismissed.

6.

However, there shall be no order as to costs. 7.

Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
