The petitioner is aggrieved by the grant of distributorship in favour of the private respondent. The allegation of the petitioner is that the private respondent obtained the distributorship upon furnishing false and incorrect residential address.

The learned advocate representing Bharat Petroleum Corporation Limited submits, upon instruction, that they have proceeded strictly in accordance with the certificate issued by the Sub-Divisional Officer in favour of the private respondent wherein the address of the private respondent was clearly mentioned. Moreover, it has also been submitted, that the residential area was not one of the eligibility criteria for grant of distributorship.

The petitioner being an unsuccessful candidate has filed this writ petition to stall the distributorship which has been awarded in favour of the private respondent. I have heard the submissions made on behalf of all the parties. It does not appear by the submission made on behalf of all the parties that the distributorship was restricted to candidates of a particular locality or area. A candidate being a citizen of India was eligible for participating in the selection process.

The petitioner as well as the private respondent participated in the selection process. The private respondent was successful.

There is no infirmity in the process followed by Bharat Petroleum Corporation Limited in selecting the private respondent on the basis of credentials submitted by her.

Accordingly, there is no merit in the writ petition. The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Amrita Sinha, J.)
