The learned advocate for the State submits that in compliance with the direction passed by this Court on September 08, 2023, he has obtained instruction from the Commissioner of School Education, Government of West Bengal, the respondent no. 2 herein that the arrear salary for the period from December 01, 2017 to August 31, 2019 after necessary statutory deductions, has been paid to the petitioner. Mr. Mandal, learned advocate for the petitioner prays for interest on the said amount.

It appears from the record that on July 29, 2021 the District Inspector of Schools (SE) Purulia, the respondent no. 3 herein requisitioned the allotment of funds to release the said arrear salary, which indicates that the claim of the petitioner was crystallized atleast on the said date, but the same has been paid to him only on September 13, 2023, therefore the petitioner is entitled to interest for two years on the principal sum @ 5% per annum.

The concerned authority is directed to pay such interest to the petitioner.

W.P.A. 17746 of 2022 is disposed of with the above terms, there shall however be no order as to costs.
