W.P.A. 18407 of 2021 (Toufik Halder vs. State of West Bengal & Ors.) Mr. Rananesh Guhathakurta Ms. S. Sengupta .... For the Petitioner Mr. Sirsanya Bandyopadhyay Mr. Subhendu Sengupta .... For the State It is submitted on behalf of the petitioner that he superannuated from service on 1st January, 2008 but was not paid his gratuity by the authority. The petitioner filed an application before the 2nd respondent to that effect in 2018 which was registered as case No. 34/18/G/HOW and the matter is still pending.

The petitioner filed an application on 10th August, 2021 before the authority praying for disposal of the matter at the earliest Having considered the submissions made on behalf of the parties and material on record, I dispose of the writ petition with a direction upon the 2nd respondent to consider and dispose of the application filed by the

petitioner dated 10th August, 2021 within a period of three months from the date of communication of this order after giving a reasonable opportunity of hearing to the affected parties including the petitioner, in accordance with law.

W.P.A. 18407 of 2021 is thus disposed of.

I have not gone into the merits of the case and the petitioner is at liberty to take all the points mentioned before this Court, before the Authority.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
