Petitioner is aggrieved by the fact that she is attempted to be thrown out of the premises being 14/6, Jhowtala Road, PS Beniapukur, Kolkata - 17. The property belongs to the mother-in-law as has been revealed from the police report. However, since the petitioner happens to be the widow of the deceased son, without due process of law the petitioner should not be driven away.

So far as the police authorities are concerned, police authorities have already initiated proceedings under the relevant provisions of law by way of Beniapukur PS Case No. 142 dated 04.08.2025 under section 85/3(5) of the BNS.

Having regard that a police case has been initiated, I am of the view that the grievance of the

petitioner at this stage has been addressed. If the mother-in-law has to advance any issue, the same may be done by approaching the appropriate Court of law.

With the aforesaid observations WPA 17243 of 2025 is disposed of.
