BD. In the matter of : Naushad Khan .... Petitioner. Mr. Mritunjay Chatterjee Mrs. Snehismita Chakraborty ... for the petitioner. Ms. Sreyashi Biswas Ms. Ratul Ghosh ... for the State. Prosecution case is that 22 Kgs. of ganja was recovered from the joint possession of the present petitioner and one co-accused namely Pancha Ansari. Learned counsel appearing on behalf of the petitioner submits that the petitioner is in custody since 23rd June, 2019 i.e., more than six years and that the other co-accused Pancha Ansari has obtained bail from this Court on 26th April 2024 in CRM (NDPS) 724 of 2024. Only five witnesses have been examined so far out of total ten witnesses and as such he may be released on bail on any terms and conditions.

Learned counsel appearing on behalf of the State opposed the bail prayer.

Having heard learned counsel appearing on behalf of the petitioner and the State and considering his period of detention and that the other accused person is on court bail and he is almost on the same footing with that

of the other co-accused namely Pancha Ansari and that there is hardly any chance of early conclusion of trial the prayer for bail made by the petitioner is allowed. Accordingly, the petitioner namely Naushad Khan, shall find bail of Rs. 10,000/- with one registered surety subject to the satisfaction of learned Chief Judicial Magistrate, Howrah.

Accordingly, C.R.M. (NDPS) 958 of 2025 is disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
