CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 2393 of 2012 In the matter of : Golam Mortaja .....petitioner. In Re : An application under Section 401 read with under Section 482 of the Code of Criminal Procedure. None appears on behalf of the petitioners or for the State.
The revisional application was preferred challenging the order dated 12-3-2012 passed by the learned Judicial Magistgrate, Lalbagh, Murshidabad in connection with M.R. Case No. 324/2011 wherein the learned court was pleased to allow interim maintenance to the wife/opposite party to the tune of Rs. 600/- per month.
Having regard to the quantum, which was granted by the learned Magistrate by way of interim measure during the pendency of the application under Section 125 of the Code of Criminal Procedure, I am of the view that no interference is called for by this court.
Accordingly, the present revisional application being CRR 2393 of 2012 is dismissed.
The opposite party/wife will be at liberty to recover all the arrears by taking appropriate application filed before the learned Magistrate.
All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
