The petitioner and the State respondents are represented. None appears on behalf of the private respondent despite service of notice.

Heard learned counsels for the parties.

It is submitted on behalf of the petitioner that he superannuated from service on 13th August, 2001 but was not paid the gratuity by the 3rd respondent for which the petitioner filed an application before the 2nd respondent on 26th October, 2018 which was registered as case No. 101/18/G/HOW, but the said application

has not been disposed of as yet. The petitioner prays for a direction upon the 2nd respondent to dispose of the said application at the earliest.

Having considered the submissions made on behalf of the parties and material on record, I dispose of the writ petition for a direction upon the 2nd respondent to consider and dispose of the application filed by the petitioner dated 26th October, 2018 within a period of three months from the date of communication of this order after affording reasonable opportunity of hearing to the petitioner, in accordance with law.

W.P.A. 18417 of 2021 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
