1. Heard Mr. Rajib Ray, learned counsel appearing for the appellant and also Mr. Lakshman Chandra Halder, learned counsel appearing on behalf of respondents.

2. By this application, the appellants are praying for condonation of 25 days' delay in filing the appeal.

3. On perusal of the causes shown in the present application, we are satisfied and accordingly, the prayer for condonation is allowed.

4. CAN 1 of 2025 is disposed of.

5. Heard the learned counsel for the appellants as well as the respondents.

6. By this appeal, the appellants are challenging the order dated 19th May, 2025 passed by the learned Single Judge in WPA 10610 of 2025 on the ground that they were not given an opportunity of hearing.

7. It is the case of the appellants that after receiving notice, some procedures are required to be followed for engagement of lawyers and it was during this period that they could not make their appearance when the matter was called up on 19th May, 2025. Learned counsel for the appellants, therefore, submits that an opportunity be given to the appellants to present the case before the learned Single Judge and therefore, the matter may be remanded back to the learned Single Judge.

8. On consideration of the submissions made by the learned counsel for the appellants and also taking into consideration the submission of the learned counsel for the appellants that certain procedures were required to be followed before engagement of a counsel, we remand the matter back to the learned Single Judge to have a rehearing of the writ petition being WPA 10610 of 2025 after giving an opportunity of hearing to all the parties. Accordingly, the order dated 19th May, 2025 is set aside.

9. The respondents/writ petitioners are also given the liberty to renew their prayer for stay before the learned Single Judge.

10. This appeal being MAT 1185 of 2025 along with the connected application being CAN 2 of 2025 are disposed of.

11. No order as to costs.

12. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
