(DB) No. 2941 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Berhampore Police Station Case No. 1232 of 2022 dated 17.09.2022 under Sections 302/34 of the Indian Penal Code read with Sections 25/27 of the Arms Act.

And In Re : Hasikul Sk. @ Hasanujjaman Sk. @ Hasnujaman ..... petitioner Mr. Ali Ahsan Alamgir Ms. Soma Mal Ms. June Modak ... for the petitioner Mr. Neguive Ahmed, learned APP Ms. Trina Mitra ... for the State Learned Counsel for the petitioner submits he is in custody for 310 days. It is also submitted that there is no direct evidence connecting him with the murder. He prays for bail. Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Statements of witnesses state that the victim had been called to the house of the petitioner. His dead body was recovered from his house. Weapon of offence has also been recovered. In view of aforesaid incriminating materials on record and gravity of the offence we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.
