2025-08-28Hon'Ble Justice Jay Sengupta2 pages

28.08.2025 Sl. No.43 NB C.R.M. (A) 2695 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bidhannagar North P.S. Case No.141/24 dated July 29, 2024 under Sections 406, 420, 419, 467, 468, 471, 34 and 120B of the Indian Penal Code.

And In the matter of: Chhaya Mahata @ Chhaya Mahto ... petitioner Mr. Navanil De, Mr. Shoumilya Mazumder.

...for the petitioner.

Mr. Ranadeb Sengupta, Ms. Rajashree Tah.

...for the State.

Heard the learned counsels for the parties.

Perused the case diary.

It is the prosecution case that the petitioner is a part of a racket involved in procuring money in the name of giving government jobs. Apart from the de facto complainant, there is another victim whose statement has been recorded. In the present case, allegedly a sum of Rupees Ten Lakhs Twenty Five Thousand was taken. The last tranche of Rupees Twenty Five Thousand was paid directly to the bank account of the present petitioner. There are incriminating WhatsApp chats and other documents available in the case diary.

Considering the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail to the petitioner.

The application for anticipatory bail being C.R.M. (A) 2695 of 2025 is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
