The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The Title Suit No.73 of 2015 is pending before the 5th Court of learned Civil Judge (Senior Division) at Alipore, District 24: Parganas (South).

In the said suit, the petitioner of the instant application under Article 227 of the Constitution of India, on March 02, 2017 has filed an application under Order XXII Rule 10 of the Code of Civil Procedure.

The petitioner is complaining delay in disposal of the said application.

An application of such nature should not have been kept pending for such a long time.

This Court is informed that August 23, 2024 is the next date fixed in the suit.

The learned Trial Judge is requested to make all endeavour to dispose of the said application on the said date; in the event the same cannot be disposed of on the

said date, it must be disposed of within two weeks thereafter.

To comply with the aforesaid direction, the learned Trial Judge is authorised not to entertain the prayer of the parties for any unnecessary adjournment. CO 2531 of 2024 is disposed of with the above terms without any order as to costs.
