The petitioner is aggrieved that the private respondent/brother-in-law is trying to oust her from her property.

Admittedly, the petitioner has a share in the property along with her brother-in-law. The property in question belongs to the late father-in-law. The parties may take out appropriate civil proceedings for demarcation of their respective shares in the property.

However, Tamluk Police Station shall ensure that there is absolutely no breach of peace in the area. In the event, the petitioner requires any police protection or posting of any police personnel in the premises, she may be granted the same by Tamluk Police Station against payment of any costs that may be assessed in terms of the Rules of the State.

The petitioner has prayed as such in paragraph 10 of the instant writ petition.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
