The question of maintainability of the writ petition is not required to be gone into at this stage, as this Court is not willing to pass any mandatory direction upon any of the authorities. The Registrar of Societies has already issued a letter to the respondent no.8 asking the respondent no.8 to answer to the irregularities pointed out by the petitioner with regard to the functioning of the society.

The Registrar is a statutory authority under the West Bengal Societies Registration Act, 1961 and amenable to writ jurisdiction. The complaint of the petitioner is that the Registrar has sat over the matter since long. 3.

As the Registrar has already initiated a proceeding, this Court expects that the said proceeding should be disposed of, upon following the principles of natural

justice and upon hearing all the parties necessary for adjudication of the dispute, within a period of four months from the date of communication of this order. The authority will act independently.

In the opinion of the Court, the Provident Fund authorities were not required to be added as respondents in this proceeding. The other issues with regard to the inter se conflict between the petitioner and the society, must be adjudicated by the appropriate forum.

Accordingly, the writ petition is disposed of. 6.

However, there will be no order as to costs.
