In compliance with the direction of this Court dated November 27, 2025, the Principal of New Town Institute of Nursing Science, Kashipur, Bhangar Phase-II, Kolkata, the respondent no.3 herein is personally present before this Court; her such appearance is dispensed with until further orders. The petitioner no.1 is complaining that she has taken admission in the aforesaid College to pursue the GNM Course but the College Authority is not allowing her to take part in the class as the West Bengal Nursing Council, the respondent no.6 herein has refused to register the petitioner no.1 in respect

of the said course for not attaining the minimum age to pursue the said course.

Mr. Abir Sarkar, learned Advocate for the Council/respondent no.6 submits that if the petitioner is eligible to be registered in respect of the said course, the respondent no.6 cannot have any objection to register her in the course.

Mr. Uttam Basak, learned Advocate for the College, the respondent no.3 herein submits that all papers relating to the admission and eligibility of the petitioner no.1 has been submitted with the respondent no.6.

Mr. Nilotpal Chatterjee, learned Advocate for the Indian Nursing Council, the respondent no.4 herein submits that the petitioner no.1 was born on August 27, 2007 and took admission in the course on June 24, 2024. The minimum age eligibility of 17 years is required to be reckoned as on the date on December 31 of the year of admission of the student. In the present case, the same would be December 31, 2024, the minimum age of the petitioner if so reckoned; would be above 17 years i.e. above the required minimum age to take admission in the GNM course.

Having heard learned Counsel for the parties and on perusal of the materials on record, it appears that the petitioner no.1 had attained the minimum age to get admission in the GNM Course.

Whether she is meeting other requirements to get admission in the said course is to be considered by the respondent no.6.

The respondent no.3 though is claiming that all papers relating to the admission and registration of the petitioner no.1 have already been placed but to avoid unnecessary controversy, the College is directed to resubmit the said papers with the respondent no.6 within a period of seven days from the date and the Council within two weeks from the date of receipt of such papers shall consider the issue of registration of the petitioner no.1 in respect of the GNM course for the session 2024-2025 in accordance with law.

With the above observations, WPA 17137 of 2025 is disposed of without any order as to costs. Parties to act on the server copy of this order downloaded from the official website of this Court.
