Learned advocate for the bank submits that notice under Section 13(2) of the SARFAESI Act is under challenge in this writ petition. Subsequently, the bank had issued a notice under Section 13 (4) of the SARFAESI Act. The petitioner has challenged the said notice and the entire proceeding initiated by the bank, before the Debts Recovery Tribunal - III in SA 430 of 2023.

On such submissions and as no one appears for the petitioner, let the matter be dismissed for default.
