Learned counsel for the State, Mr. Santanu Kumar Mitra, on instructions submits, that the milk van has been released against an undertaking of the petitioner.

It is, however, submitted that despite repeated request, the petitioner is not coming forward to record a statement in order to assist with the enquiry. Appropriate steps may be taken by the parties in accordance with law.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
