It is submitted on behalf of the petitioner that the disputes being the subject matter of the writ petition has been settled. A Memorandum of Settlement dated 21st December, 2023 was executed between the writ petitioner and the respondents no.2, 3 and 4 which was filed before the learned First Labour Court, West Bengal at Kolkata in case No.COMP.17 of 2023. A copy of the joint affidavit affirmed on 21st December, 2023 with a copy of the Memorandum of Settlement dated 21st December, 2023 annexed thereto which was filed before the learned First Labour Court, West Bengal at Kolkata is placed before this Court and is taken on record.

On a perusal of the joint affidavit as also the Memorandum of Settlement annexed thereto, it is apparent that the respondents no.2, 3 and 4 were entitled to receive a sum of Rs.23,13,429/- which has been paid by way of a Demand Draft dated 15th December, 2023.

In view of the aforesaid facts and circumstances, the matter is taken up in the absence of the respondents.

Nothing further remains to be adjudicated in the writ petition.

The writ petition is accordingly dismissed for non-prosecution recording the settlement as aforesaid. Interim order, if any, stands vacated.
