Learned senior advocate appearing for the petitioner submits that, the petitioner is in custody for about 229 days. The trial is yet to commence. There hardly any evidence as against the petitioner. She submits that, post mortem report suggest that the deceased consumed rice subsequent to 9 p.m. and therefore there is a gap of at least three hours between the time when the petitioner was last seen with the deceased. Learned advocate appearing for the State draws the attention of the Court to the contents of the case diary and to the statement recorded under Section 164 of the Code of Criminal Procedure (Cr. P. C.). He submits that, the petitioner was identified in the T.I. parade.

Considering the materials in the case diary and considering the gravity of the offence as also the involvement of

the petitioner therein, we are unable to grant bail to the petitioner.

Accordingly, prayer for bail of the petitioner is rejected and the application being CRM 7592 of 2021 is dismissed. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
