Mr. Swapan Kumar Mallick Ms. Sudeshna Das .....For the Petitioner The present application has been preferred against the judgment and order dated 31.05.2022 wherein the Learned Appellate Court in Criminal Appeal No.132 of 2015 was pleased to hold the appellant not guilty and set aside the order of conviction and sentence passed by the Learned Judicial Magistrate, 10th Court, Alipore in Compliant Case No.1306 of 2008 (TR No.217 of 2008).

The reasons so assigned in the application are found to be just and sufficient.

Accordingly, the petitioner is granted leave to prefer Memorandum of Appeal within 30 days from date.

Thus, C.R.M.S.P.L. 45 of 2022 is allowed.
