In view of the report filed by the Commissioner clarifying the issue that the appellant no. 1 is a OBC-A category candidate has secured 80 marks even after addition of two marks would not qualify as the total marks would still be less than the last candidate called for in the OBC category and the same is the situation with regard to the appellant no. 13 who had originally secured 70 marks and with the addition of marks which is less than the last candidate called for in the General category. Considering the above, we are unable to grant any relief to the appellants. Hence, the appeal stands dismissed. Consequently, the connected application also stands dismissed.
