Petitioner is directed to serve a copy of the revisional application upon Mrs. Ratna Ghosh, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. The grievance of the petitioner is that the case was initiated in the year 2011 being Balurghat P. S. case no. 312 of 2011 wherein the chargesheet was submitted under Section 408 of the Indian Penal Code.
Learned advocate submits that charge was framed on 7th February, 2019 and till date no witness has been examined. The next date has been fixed for the purposes of this case in November, 2023.
Having considered the factum that the case was initiated 12 years ago, I direct the learned C. J. M/A.C.J.M or any Judicial Magistrate in charge of G. R. Case No. 675 of 2011 to fix at least one date in a month for the purposes of the present case from the
next date so fixed for evidence.
The learned trial court would ensure that for the purpose of this case if any resolution is taken by the local bar, the trial of the case should proceed. The Deputy Superintendent of Police, in Charge of Balurghat PS would act as a Nodal Officer and ensure regarding the presence of the witnesses in connection with the instant case, henceforth from the date fixed on November, 2023. All efforts be taken for concluding the trial of the case at the earliest.
With the aforesaid observations, the present revisional application being CRR 2697 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
