Partition Suit No.102 of 2012 was placed before the National Lok Adalat. Record reveals that the partition was settled out of court and the parties were willing to get the dispute compromised in terms of the compromise petition filed jointly by both sides before the National Lok Adalat. The compromise petition along with a sketch map was sent back to the learned Civil Judge (Senior Division), Balurghat, Dakshin Dinajpur, for necessary decree as per law.

It is submitted that valuation report was submitted by the Additional Sub-Registrar, Dakshin Dinajpur. Accordingly, Serestadar was directed to submit a report regarding assessment of stamp duty as per the valuation report of the ADSR (Sadar) Balurghat. It is submitted that the suit did not proceed thereafter.

Considering the age of the suit and the stage of the suit, this Court is of the view that the prayer for expeditious disposal of the suit is reasonable.

An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisional application upon the opposite parties is not required. The prayer is innocuous.

Under such circumstances, the revisional application is disposed of with a direction upon the learned court below to dispose of the suit within a period of two months from the next date fixed on the basis of the direction of the National Lok Adalat.

This Court has not gone into the merits of the suit. A copy of the revisional application, along with a server copy of this order, be served upon the opposite parties within a week.

The revisional application is, thus, disposed of. There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
