Learned counsel appearing for the petitioner submits that the respondent authorities have not taken any steps in recovering the wife of the petitioner who was abducted by the respondent no.6. On query from the Court, the petitioner further submits that the age of the wife is about 32 years.

Learned counsel appearing for the State files a report and submits that a statement of Ms. Priyanka Goswami Sarkar, who is of 33 years of age, the petitioner's wife, has been recorded under section 164 of the Code of Criminal Procedure by the learned Judicial Magistrate, 3rd Court, Malda. In her statement she categorically stated that she does not wish to stay with her husband.

Heard learned counsels for the parties.

As the wife of the petitioner does not wish to stay with her husband and is evident from the statement

recorded by the learned Judicial Magistrate, 3rd Court, Malda, this Court does not wish to entertain this writ petition.

The Writ Petition being WPA 18178 of 2024 is disposed of.

Report filed by the State is kept with the record. There shall be no order as to costs.
