The grievance of the petitioner in the present writ application that a work order was issued to the petitioner in connection with construction of 02 ACR at Pandua A. K. High School (H.S.) under Gazole Block, Malda for the year 2023-24.

2. On receipt of the work order, the petitioner has completed the work and the headmaster of Pandua A. K. High School had issued the completion certificate certifying that the construction work sanctioned from SSM, Malda in the year 2023-24 has been completed including electrical work and twenty set high low bench as per the work order no. 516/CIVIL/SSM dated September 4, 2023.

3. After the completion of the work the petitioner has submitted bill but in spite of the receipt of the bill the respondents/authorities how not considered the same and the same is still pending before the authorities.

4. Learned counsel for the petitioner further submits that after submission of bill, the petitioner has made several reminders but the same has also not been considered.

5. Heard the learned counsel for the parties perused the materials on record. There is no dispute with regard to issuance of the work order in favour of the writ petitioner and it is also not in disputed with regard to the completion of work by the petitioner. The headmaster of the concerned school has issued completion certificate dated 07.12.2024.

6. Considering the above, this Court finds that no purpose would be served by keeping the present writ application pending.

Accordingly, the writ petition is disposed of by directing the respondent no. 6 to consider the representation and the bill dated December 9, 2024 submitted by the petitioner within a period of eight weeks from the date of receipt of this order and the authorities find that the petitioner is entitled to get the payment, the respondents shall release the payment within two weeks thereafter. If the respondents find that the petitioner is not entitled to get any amount, a reasoned and speaking order be passed.

8. Accordingly, WPA 17157 of 2025 is disposed of.

9. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
