Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner is aggrieved by the excesses of the police authorities and to that effect, information was furnished to the Officer-in-Charge, Cyber Cell South Suburban Division and the Deputy Commissioner of Police, Cyber Cell South Suburban Division. Petitioner advances his reasons and arguments for defreezing bank account of HDFC Bank Limited. Petitioner claims that there has been a business transaction pursuant to which amounts were being received, but somehow or the other, said money has been frozen by the police authorities and there is no information to the petitioner on what count the said account has been frozen.

State has submitted a report which reflects that Kasba P.S. Case No. 352 dated 07.09.2024 was registered for investigation. The subject-matter of the case related to digital arrest and since the money trail was found in respect of a disputed amount which has been transferred into the HDFC Bank Account bearing No.01642320005527, steps were taken by the police authorities.

Having considered that prima facie the police authorities have acted pursuant to a criminal case being registered and which is being investigated till date, I am not inclined to interfere with the freezing of the aforesaid account at the behest of the investigating authority in connection with the aforesaid criminal case. However, petitioner will approach the learned ACJM, Alipore for ventilating his grievance as it is complained that return of money was without knowledge of the present petitioner. In case such an application is filed, learned Magistrate will assess regarding the allegations made by the petitioner and by calling for reports from the appropriate authorities, arrive at his own finding independently, without being influenced by any observations made by this Court. With the aforesaid observations, the writ petition being WPA 17262 of 2025 is disposed of. There will be no order as to costs.
