Report submitted by the Superintendent of Police, Birbhum through the learned advocate for the State be kept with record. The report reflects that further investigation of the case is in progress and the police authorities are yet to reach their final opinion regarding the investigation which is carried on. In view of the aforesaid, Mr. Ahmed, learned advocate for the petitioner do not intend to press the revisional application and prays for liberty to approach this court after the report under Section 173 Cr.P.C is filed before the jurisdictional court. Mr. Sur, learned Additional Public Prosecutor appears on behalf of the State, In view of the submissions advanced on behalf of the learned
advocate for the petitioner, the revisional application being CRR 2320 of 2021 is dismissed as withdrawn.
Pending applications, if any, are consequently disposed of. Petitioner is granted liberty to approach this court after the report in respect of the further investigation is submitted before the jurisdictional court.
The Officer-in-Charge, Paikar Police Station is present in court. His further appearance before this court is dispensed with accordingly.
