This is an application for special leave to appeal filed by the petitioner. On the basis of a complaint submitted by the petitioner in the Court of the Learned Chief Judicial Magistrate, Paschim Medinipore cognizance was taken against the private opposite parties under Sections 323/379/506 of the Indian Penal Code on 3rd August, 2012. The said complaint was registered as C.R. Case No. 908/2013. The Learned Chief Judicial Magistrate, Paschim Medinipore took cognizance on 18th November, 2013 and transferred the case to the 1st Court of the Learned Judicial Magistrate, Paschim Medinipore for disposal. By an order dated 26th September, 2016 the accused persons/private opposite parties were discharged under the provision of Section 25 of the Code of Criminal Procedure on the ground that the complainant for last three years failed to produce any evidence in support of his charge.

Considering the order passed by the Learned Judicial Magistrate, 1st Court at Paschim Medinipore this Court finds that the impugned order does not suffer from any infirmities and for non-production of evidence the accused

persons/private opposite parties were discharged from the charge.

For the reasons stated above, I do not find any merit in the instant application for special leave to appeal. The same is, therefore, dismissed.
