C 1844 of 2001 (The Calcutta Stock Exchange vs Dinesh Kumar Singhania) pending before the Court of learned 9th Metropolitan Magistrate at Calcutta.

It is submitted that the present complaint case has been initiated in the year 2001 and at page 27 of the revisional application is an order dated 13.09.2011 passed in CRR 2421 of 2011 wherein the petitioner had earlier approached this Hon'ble Court with the same prayer for expeditious disposal. Vide order dated 13.09.2011 a co-ordinate bench of this Court had directed the Trial Court positively disposed of the complaint case within 90 days from the date of the order (13.09.2011) but as the said case was not disposed of within the time framed as directed the petitioner again approached this Hon'ble Court vide the present revision in the year 2023.

years have passed since the order dated 13.09.2011 passed and 22 years have passed since the complaint was filed before the Trial Court. A report as called for has been submitted by the learned Metropolitan Magistrate, 9th Court, Calcutta in-charge through the learned Chief Judge, City Sessions Court, Calcutta.

Perused the said reports.

It is submitted by the learned counsel for the petitioner that the next date is fixed on 12th of September, 2023 for further evidence.

Considering the said circumstances and the unfortunate situation wherein the petitioner is praying for justice for the last 22 years, the Metropolitan Magistrate, 9th Court, Calcutta in-charge shall make all endeavour to dispose of the case in accordance with law by the 10th of October, 2023 by preferably conducting a day to day hearing.

The criminal revision being CRR 2698 of 2023 is accordingly allowed.

Interim order, if any, stands vacated.

All connected applications stand disposed of. Let a copy of this order be sent to the learned Chief Judge, City Sessions Court and the learned Trial Court for necessary compliance.
